Reasonable Participation Test; Mandatory Standard under Condo Act s.45(6)–(8). by (Franklin Govindu) Bill 91 (Less Red Tape, Stronger Economy Act, 2023) took effect on October 1, 2023, and amended the Condominium Act, 1998 to add subsections 45(6) to (8). Those provisions impose what I call the “Reasonable Participation Test”: any electronic/virtual AGM is lawful only if every person entitled to attend is given a fair and equal opportunity to participate. This is not optional or a matter of managerial discretion—it is a statutory precondition to the validity of the meeting. Section 52 proxy rights must also remain fully intact; any process that weakens proxy use, verification, scrutineering, or auditability fails the Test and the Act. I was the first to identify and consistently apply this statutory Test in our community. No lawyer, manager, or board can waive, dilute, or ignore it. By omitting subsections 45(6), to (8) and failing to address proxy rights under section 52, Sir Lawyer Greg Marley’s November 21, 2024 “Virtual AGM” letter (Council for YCC456 ) misled owners into believing the Board had unlimited discretion and falsely portrayed my reliance on the Act as baseless. My position is not an interpretation of convenience; it is the plain text and structure of the statute. Compliance is mandatory. Departures are unlawful and voidable. Pro: Great location. Closer to everything that you might need. Good scenery all around. Good mix of people from all around the world Con: Parking is a joke New Building maintenance lacks the skills . Random, frequent water shutoff for entire building is very common. To top it off, they never communicate when work is done you keep guessing. Getting delivery can be challenging due to elevator booking. Some just won't deliver to this condo area. Marijuana smell in some floors is absolutely horrible.

Great building to live in. The corporation is really well run and responsive to any issues that might arise. They take good care of all the common elements. I’ve been er seen any pest in my 2 years here. One thing I’m not a fan of is the slow-opening garage door and the parking situation in general - very narrow and most drivers are pretty reckless and inconsiderate.

Cons This is a beautiful condo. However, the management is very snobbish. The elevator is always broken. The parking lot is very slow to go in and out. I lived here for a year and there wasn’t a day when I didn’t find any issues with the building or the rush at the parking. Because the rooms are asymmetrical, you cannot place your furniture perfectly. The view is fantastic and the rooms are very bright. It’s great if you are a bachelor trying to impress women. I personally had success with that every time. So, maybe that’s why I stayed. Then I grew out of it. Decided I needed something a bit more practical.
